Therefore, waiting can result in more expensive upgrades.<\/li>\n<li>LL88 requires upgrades not only for common areas, but for tenant spaces. In addition, an\u2002annual $500 fine will be assessed for each covered tenant space without a submeter until all required submeters are installed.<\/li>\n<\/ul>\n<h3><\/h3>\n<h3 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"LOCAL_LAW_88_Compliance_Report\"><\/span>LOCAL LAW 88 Compliance Report<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><strong>The Law requires an initial report from a registered design professional or a licensed electrician. This report should provide the following information:<\/strong><\/p>\n<ul>\n<li>The lighting system in the entire building has\u2002been inspected.<\/li>\n<li>The lighting upgrades you have done\u2002are as per the law.<\/li>\n<li>Each covered tenant space is metered with\u2002sub-meters.<\/li>\n<\/ul>\n<p>This report has to be presented to the NYC Department of Buildings by 1 May 2025.<\/p>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"How_to_Understand_If_Your_Building_Needs_a_Lighting_Upgrade\"><\/span>How to Understand If Your Building Needs a Lighting Upgrade<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Local Law 88\u2002mandates that lighting systems comply with the current New York City Energy Conservation Code, which may necessitate upgrades to LED lighting or the inclusion of daylighting or occupant controls.<br \/>\n<strong>You do not need to upgrade lighting\u2002for:<\/strong><\/p>\n<ul>\n<li>Any lighting systems installed on or after\u2002July 1, 2010, that met the code at the time of installation.<\/li>\n<li>Lighting systems in dwelling units, or spaces serving such dwelling units, in occupancy groups R-2 or\u2002R-3.<\/li>\n<li>Lights are within occupancy group A-3, located inside a house of worship.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"How_to_Understand_If_You_Need_to_Install_Sub-Meters\"><\/span>How to Understand If You Need to Install Sub-Meters<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>Non-residential and mixed-use board operators and building owners are required to set up electric sub-meters in\u2002each significant non-residential occupant space with more than 5,000 sq. ft.<\/p>\n<p><strong>For multi-tenant non-residential buildings (all floors or parts of floors), the following must\u2002be provided to each tenant:<\/strong><\/p>\n<ul>\n<li>An individual sub-meter<\/li>\n<li>A sub-meter shared with other tenant spaces on the same floor<\/li>\n<li>One shared sub-meter for\u2002the whole floor<\/li>\n<\/ul>\n<p>The boards and building owners\u2002must also furnish each non-residential tenant with monthly electrical statements. Those bills must specify the electricity usage recorded by\u2002the sub-meter for that billing period and the fees.<\/p>\n<p><strong>Tenant spaces that meet\u2002one of the following criteria must be submetered:<\/strong><\/p>\n<ul>\n<li>One or\u2002more floors of a covered building where a single tenant space of 5,000 or more gross square feet is rented or subleased to the same individual.<\/li>\n<li>A single covered floor of a building in excess of 5,000 gross square feet with spaces leased or sublet to two\u2002or more different individual persons.<\/li>\n<\/ul>\n<p><strong>This applies\u2002to both commercial and multifamily properties. But\u2002there are some exceptions, including the following:<\/strong><\/p>\n<ul>\n<li>Residential units in an apartment house or one- to two-family\u2002dwelling with not more than two apartments<\/li>\n<li>Tenant spaces where\u2002electrical consumption is already measured through a dedicated meter.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h4 style=\"text-align: center;\"><span class=\"ez-toc-section\" id=\"Tips_for_Compliance\"><\/span>Tips for Compliance<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p><strong>Building owners should undertake the following measures to comply with LL88:<\/strong><\/p>\n<ul>\n<li><strong>Performing a Lighting Audit:<\/strong> Audit\u2002your lighting to determine your property&#8217;s needs. This will help you discover the areas in your home with the most\u2002energy waste and focus on upgrading them first.<\/li>\n<li><strong>Check for Existing Exemptions:<\/strong>\u2002Check if any exemptions apply to your current lighting system.<\/li>\n<li><strong>Institutionalize\u2002an Upgrade Plan:<\/strong> Design a systematic upgrade plan for your lighting system that enables you to monitor progress via meter settings.<\/li>\n<li><strong>Exit Sign Power:<\/strong> Ensure exit\u2002signs use no more than 5 watts.<\/li>\n<li><strong>LED Installations:<\/strong>\u2002Provide energy-efficient LED lights or other approved equally high-efficiency lights (e.g., compact fluorescent lights).<\/li>\n<li><strong>Use Lighting Control\u2002Systems:<\/strong> Most commercial sectors need solutions such as smart lighting, occupancy and daylight harvesting, demand response, and centralized control to optimize energy use.<\/li>\n<li>Work Lighting\u2002Enhancements: Consider including work lighting enhancements in standard lease agreements, where applicable.<\/li>\n<li><strong>Maintenance Plan:<\/strong> Develop a\u2002proactive lighting maintenance plan to help ensure the longevity and performance of your retrofitted lighting system.
